Mycompensation.com.au was created to accommodate the large number of injured people seeking compensation help and advice for the injuries and loss they have suffered.

If you or someone you know of has suffered an injury, pain or suffering, then you are entitled to make a claim for compensation to recuperate any loss of income, medical and rehabilitation costs or future economic losses.

To see whether you can claim compensation, complete our Compensation Enquiry Form by selecting the area of the law that concerns your matter as well as providing us with the details of your incident and injuries involved.

Each year thousands of road accidents occur throughout Australia. Most of us in our lives will probably have the misfortune of experiencing at least one road traffic accident.

Road accidents can cause serious personal injuries and trauma to the victims involved. If you have been involved in a road accident (either as the driver or passenger) and have suffered an injury, it is worth finding out if you can claim compensation for that injury as a result of the accident.

There are many different accidents which can occur on the road. Some of these include:

  • Car accidents
  • Passengers in motor accidents
  • Cyclist accidents
  • Motorcycle accidents
  • Pedestrians being hit by a motor vehicle
  • Truck accidents
  • Public transport accidents

If you have suffered an injury, whether it is temporary or permanent, then you are entitled to make a claim for compensation to recuperate any loss of income, medical expenses, rehabilitation costs and future economic losses.

To see whether you can claim compensation, complete our Free Online Compensation Enquiry Form – and find the compensation you deserve!

The types of accidents and unfortunate incidents that occur the most on our roads or whilst driving a motor vehicle are outlined as follows:

Car Accidents

The majority of car accidents that occur on our roads is largely due to speeding, disobeying road rules, inexperience or negligent driving. By law, all car drivers must have compulsory third party (CTP) insurance. This means that their CTP insurers will cover the driver in an accident causing injury to any other party. This cover also extends to any passengers, whether related to the driver or not. If you are unfortunate enough to be involved in an accident with an uninsured driver, or with an unidentified driver who doesn't stop after the accident, then your claim is likely to be covered by an insurance organisation set up by the Government specifically to cover such incidents.

Car accidents can cause a wide variety of injuries. Usually the severity of the injury will depend upon the impact and type of collision involved. Aside from the driver of a motor vehicle being injured, passengers travelling in the vehicle can suffer the same or in some cases more severe injuries than the driver. Ultimately it is the driver’s responsibility to drive safely and to avoid having any accidents whilst there are passengers in the car. It does not matter whether the driver is your friend or family relative, you can still make a compensation claim as the driver will be covered by their insurance policy.

So if you have been injured in a road accident or car crash, then you are entitled to make a compensation claim for your injuries. It is important to remember that after the accident has occurred, you need to put forward your claim as soon as possible as time limits do apply for the making of a claim. To see whether you can claim compensation for your injuries as a result of a motor accident, then please complete our Free Online Compensation Enquiry Form.

Motyorcycle Accidents

The majority of motorcycle accidents involve collisions with another motor vehicle such as a car or a truck. However, motorcycles and motorbikes are also more vulnerable to skidding on spillages on the road surface such as mud, oil or other hazardous material. In road accidents like these, a compensation claim can usually be made either against the person or organisation responsible for the spillage, or against the local authority or road traffic authority whose responsibility it is to maintain the roads.

Motorcyclists are particularly at risk from injuries if they are involved in an accident or collision with another vehicle as they are more exposed and have less protection than other motorists. A lack of seatbelts or other protection has contributed to the higher level of injuries and fatalities amongst motorcyclists than any other group of road users. If you are a motorcyclist who has suffered from an injury as the result of a motor accident, then you are entitled to put forward a claim for compensation .To see whether you can claim compensation, please complete our Free Online Compensation Enquiry Form.

Pedestrians in Motor Accidents

Accidents on the road can cause serious injuries and as a pedestrian, you are more likely to receive serious personal injuries than the motorist that collided with you as you have far less protection. There are many different ways in which you could be injured as a pedestrian.

Modern cars are designed primarily to protect the driver and passengers, although in recent years the addition of various safety devices to the outside of cars has helped to reduce injuries caused to pedestrians who are hit by cars. Drivers should always give way to pedestrians when they are crossing the road, as well as being aware, particularly in both city and suburban areas, that people may try to cross the street without warning.

If you have been involved in a road/car accident as a pedestrian then you are entitled to pursue a claim for compensation for personal injuries against the insurance company of the driver whose vehicle hit you. Even in the case of 'hit and run' drivers who leave the scene or uninsured motorists, you can still pursue a compensation claim through a government scheme set up to compensate the victims of uninsured and unidentified motorists. To see whether you can claim compensation, please complete our Free Online Compensation Enquiry Form.

Cyclist Accidents

Just like motorists, cyclists must obey all the road rules. This includes obeying stop signs and traffic lights, riding on the left side of the road and giving way to pedestrians on crossings. Cyclists have the same rights and responsibilities as any other road user.

However, cyclists are not as protected as motorists and therefore when a cyclist does become involved in an accident, it is more likely the cyclist will suffer severe injuries, Therefore, it always critical for motorists to always be alert and watchful for cyclists while on the road.

If you are a cyclist who has been injured in a road accident, then you are entitled like all other motorists and road users to put forward a compensation claim for the injuries you have received. To see whether you can claim compensation, please complete our Free Online Compensation Enquiry Form.

Public Accidents can happen anywhere in public and are usually the result of someone else’s negligence or a breach in the safety standards required. The owner or tenant of a premise has a duty of care to ensure that the premise is kept safe for people who come onto the premises. The most common places where public accidents take place include supermarkets, shopping centres, fitness centres, council property, restaurants, schools and people’s homes.

If you have suffered an injury, whether it is temporary or permanent, then you are entitled to make a claim for compensation to recuperate any loss of income, medical expenses, rehabilitation costs and future economic losses.

To see whether you can claim compensation, complete your Free Online Compensation Enquiry Form – and find the compensation you deserve!

Slips, Trips and Falls

This category is fairly broad but in essence a claim for compensation for personal injury can be made where a slip, trip or fall has occurred which was not your fault and was the direct result of the area or floor in question being in a dangerous and hazardous state.

There are many different ways and circumstances in which slips, trips and falls can occur. Some of the most common types of accidents involving slips, trips and falls include:

  • Trips and slips caused by dangerous and defective
  • roads and pavements.
  • Trips and slips in shops or other public places
  • Slips caused by dangerously slippery or wet floors
  • Slips caused by over polished floors
  • Trips caused by dangerous carpets or flooring
  • Trips caused by obstructed walkways
  • Trips and falls caused by broken concrete
  • Trips and falls caused by uneven flooring
  • Trips and falls caused by cracked footpaths
  • Trips and falls caused by tree roots
  • Trips and falls caused by misplaced objects
  • Falls caused by dangerous or hidden stairs

The best way to prove that an area is dangerous and thus a tripping hazard is by providing photographic evidence. It is essential that the exact location and exact defect is identified and it is always a question of fact as to whether or not the area was dangerous or not. The law applies common sense rules in cases such as this.

However as with all claims it is preferable if witnesses are available to give evidence. It is also beneficial to a claims success if you report your matter to the Shopping Centre Management or Shopping Centre Security.

If you have been injured from an unfortunate accident, such as a slip, trip or fall, then please feel free to complete our FREE Online Compensation Enquiry Form and discover the compensation you deserve!

Other Public Accidents

There are many different types of accidents and unfortunate mishaps that can occur when you are out in public, but remember, if the accident was not your fault, then you are entitled to make a claim for compensation. You do not need to worry about claiming compensation if your accident occurred at someone else’s home or property, even if that person is a friend or relative, as there would normally be public liability insurance which will cover the property owner.

Our service is absolutely free of charge! So if you have been involved in an accident, please don’t hesitate to complete our FREE Online Compensation Enquiry Form to find out how we can help you achieve maximum compensation for your injuries!

If you, or a loved one, are the victim of medical negligence, incompetence or carelessness then you may be entitled to claim compensation for injuries suffered. This is more commonly known as Medical Negligence. Naturally it applies to doctors, surgeons and nurses, but it also applies equally to other forms of medical care and treatment including dentistry.

Just like other professions and practices, the medical profession has what is called a "duty of care" towards their patients, that is, a duty to ensure that they receive proper treatment, in the proper manner. If they break this duty and the person they are treating suffers in any way as a result, then the victim has a potential claim for compensation. It all comes down to trying to establish whether the action taken, or not taken, was reasonable in all the circumstances.

Some cases will be more straightforward then others - administering the wrong medication, or giving too much or too little medication, are fairly straightforward cases in which negligence is likely to be easily established. More difficult cases include possible claims for infections caused whilst under medical care and attention.

Most clinical negligence claims need time for proper investigation and opinions from other medical and legal experts, but if you believe you have suffered from an act of medical negligence then you should complete our FREE Online Compensation Enquiry Form to find out whether you are entitled to claim compensation.

Mycompensation.com.au was created to accommodate the large number of injured people seeking compensation help and advice for the injuries and losses they have suffered.

The core function of our website is to provide you with free online legal information, support and advice for people who have a legal matter involving physical or psychological injuries as the result of a personal accident, motor accident, workplace accident or someone else’s negligence.

We believe that everyone should be made aware of their legal rights and legal entitlements in regards to claiming compensation. Our concern is that those people who are injured in an accident or mishap end up moving on through life, without ever making a claim for compensation. This is due to the fact that people are not being made adequately aware of their legal rights and entitlements or feel they cannot afford to seek legal representation and advice.

The aim of our website is to promote awareness amongst the community by providing free help and assistance to people, like yourself, who:

  • cannot afford to pay for legal representation.
  • want to know what their compensation entitlements might be.
  • are unable to consult with a lawyer due to physical constraints.
  • have been injured in an accident and don’t know where to start.
  • require compensation advice for the injuries they have received.
  • have a relative or friend in need of compensation help and advice.
  • are unable to take time off from work to seek legal representation and advice.
  • have children under the age of eighteen who have been injured in an accident.
  • want to have their matter assessed by a professional compensation legal specialist - free of charge.

If you or someone you know of has suffered an injury, whether it is temporary or permanent, then you are entitled to make a claim for compensation to recuperate any loss of income, medical expenses, rehabilitation costs or future economic losses.

Accidents at work are very common and can occur in any job. Every employer has a duty to look after the safety of their employees in their workplace, whether this is an office, a factory, a warehouse, outside, or anywhere an employee is required to work. Even on the road, an employee provided with a vehicle to use for work purposes can expect that vehicle to be safe and roadworthy.

The duties of an employer include complying with health and safety laws, and complying with the many workplace regulations which have been put in place to make the workplace a safer environment and reduce the risk of work accidents occurring. Proving the employer was at fault will require a good knowledge of the laws and regulations about work accident claims. Good legal advice and guidance is essential for anyone injured in an accident at work.

Accidents at work can occur in just about any occupation across any given industry. Some of the most common injuries that occur include the following:

  • Back, upper and lower limb injuries usually the result of inadequate job training, lack of supervision from the employer and an unsafe work environment.
  • Repetitive strains or sprains due to an overload in work or unrealistic demands placed on an employee.
  • Industrial deafness from prolonged exposure to unsafe noise levels.
  • Psychological injuries due to the trauma of a previous accident or the build up of stress and anxiety due to the type of work and/or work environment.
  • Hazardous chemicals and asbestos exposure within the workplace.

If you have suffered an injury at work, whether it is temporary or permanent, then you are entitled to make a claim for compensation to recuperate any loss of income, medical expenses, rehabilitation costs and future economic losses.

To see whether you can claim compensation, complete our Free Online Compensation Enquiry Form – and find the compensation you deserve!

The type of accident and the severity of the injuries will largely depend on the type of work performed . Some of the most common work accidents include the following:

Office Accidents

Office injury claims tend to arise as a result of inadequate workstations and seating arrangements, bad ergonomic planning for desk workers, slipping or falling over unseen obstacles and injuries from inappropriate lifting. Just as with factories and construction sites, as with any working environment, offices are subject to Health and Safety legislation. This puts duties on employers to make sure that the office is safe for employees, and the way in which they are required to carry out their duties is also safe and complies with all relevant Health and Safety regulations.

If you have suffered from an injury in the office or the workplace, then you are entitled to put forward a workers compensation claim. To see whether you can claim workers compensation, please complete our Free Online Compensation Enquiry Form.

Construction & Industrial Accidents

Building sites, industrial areas and in particular places where construction work is being carried out is notorious for the risk of injury. A wide range of accidents and injuries to workers occur every year on construction sites and in industrial areas. Subsequently, it is the duty of an employer of a workplace or the supervisor of a job site to ensure that their workers receive adequate job training, proper supervision and to provide a safe and hazardous free work environment. In addition, employers have to comply with many safety regulations in relation to the way a construction site or industrial area is managed and handled. Factory and Shop Accidents

Employees in factories, warehouses, retail shops, food shops and commerical shops have the same protection as other employees in respective industries when it comes to occupational, health and safety. The employer has a duty to comply with all the relevant statutory requirements and regulations about safe working practices and safe premises in which to work. This includes making sure that the floors of a premise are clear of slippery substances like grease or spillages, which can cause slip and fall accidents. In addition, the work area must also be kept clear of obstructions and tripping hazards, machinery, tools and products have to be safely guarded and safety shoes and protective clothing should be worn. The purpose of this is to minimise the risk of an accident and subsequent injuries occuring.

When new employees begin in the workplace, they should receive proper and thorough induction training into the safety procedures and safety rules which are to be understood and complied with at all times. It follows that where there are any breaches of these requirements and an accident occurs causing injury to you, then it is within your rights to seek compensation for your injuries.
